How we handle your data and your rights: Information in accordance with Articles 13, 14 and 21 of the General Data Protection Regulation (GDPR)

With this data protection notice we inform you, our customers and interested parties, in accordance with the EU General Data Protection Regulation (GDPR), which will apply from May 25, 2018, about the processing of your personal data by us and about your rights. 2. Which sources and data do we use from you?
We process data that we have received or have already received from the business relationship with you. We receive the data directly from you, e.g. when you make an inquiry or prepare an offer.
Specifically, we process the following data:
Personal data (e.g. first name, surname, title) in exceptional cases, date of birth and private address

3. What do we process your data for (purpose of processing) and on what legal basis?
In the following, we will inform you about what we process your data for and on what legal basis.
3.1 To fulfill contractual obligations (Art. 6 Para. 1 Letter b GDPR)
We process your data to carry out our contracts with you, ie in particular to carry out your orders. The purposes of the data processing depend in detail on the specific product and the contract documents.
3.2 As part of the balancing of interests (Art. 6 Para. 1 Letter f GDPR)
We can also use your data on the basis of a weighing of interests to safeguard the legitimate interests of us or of third parties. This is done for the following purposes:
General business management and further development of services and products
Advertising, market and opinion research, assertion of legal claims and defense in legal disputes
Prevention and investigation of criminal offenses
The limited storage of data if deletion is not possible or only possible with disproportionately high effort due to the special type of storage

As far as the specific purpose permits, we process your data in pseudonymized or anonymized form.
3.3 Based on your consent (Art. 6 Paragraph 1 Letter a GDPR)
If you have given us your consent to process personal data, the respective consent is the legal basis for the processing mentioned there.
You can revoke your consent at any time with effect for the future. This also applies to declarations of consent that you gave us before the GDPR came into effect, i.e. before May 25, 2018. The revocation is only effective for future processing.
3.4 Due to legal requirements (Art. 6 Para. 1 Letter c GDPR)
We are subject to various legal obligations, i.e. legal requirements. The purposes of processing include the fulfillment of tax control and reporting obligations.
4. Who will get my data?
Your data will only be passed on if a legal basis allows this. Within Toolmaker, those departments receive your data that need it to fulfill our contractual and legal obligations or to fulfill their respective tasks (e.g. sales and marketing).
In addition, the following offices can receive your data:
Processors employed by us (Art. 28 GDPR), in particular in the field of IT services, logistics and printing services, who process your data for us in accordance with our instructions
Public bodies and institutions (e.g. tax authorities) if there is a legal or official obligation
5. How long will my data be stored?
If necessary, we process your personal data for the duration of our business relationship, which also includes the initiation and processing of a contract. In addition, we are subject to various retention and documentation obligations, which result, among other things, from the German Commercial Code (HGB). The periods for storage and documentation specified there are two to ten years. Finally, the storage period is also assessed according to the statutory limitation periods, which, for example, according to §§ 195 ff. Of the German Civil Code (BGB) can be usually three years, but in certain cases also up to thirty years.
6. Will data be transferred to a third country or international organization?
We only transfer your data to countries outside the European Economic Area - EEA (third countries) if this is necessary for the execution of your orders or is required by law or you have given us your consent.
7. What data protection rights do I have?
You have the right to information under the respective legal requirements (Art. 15 DS-GVO, § 34 Federal Data Protection Act (BDSG) in the version valid from May 25, 2018). To correction (Art. 16 GDPR), to deletion (Art. 17 GDPR, § 35 BDSG), to restriction of processing (Art. 18 GDPR) as well as to (Art. 20 GDPR). 8. Is there an obligation for me to provide data?
As part of our business relationship, you only need to provide the personal data that is necessary for the establishment, implementation and termination of a business relationship or that we are legally obliged to collect.
Without this data, we will usually have to reject the conclusion of the contract or the execution of the order or we will no longer be able to carry out an existing contract and may have to terminate it.
9. To what extent is there automated decision-making in individual cases?
In principle, we do not use automated decision-making in accordance with Art. 22 GDPR to establish and implement the business relationship. If we use these procedures in individual cases, we will inform you about this separately, provided this is required by law.
10. To what extent will my data be used for profiling?
We process your data partially automatically with the aim of evaluating certain personal aspects (so-called "profiling" according to Art. 4 No. 4 GDPR). We use profiling, for example, to determine your potential interest in our products and services. This evaluation is carried out on the basis of statistical methods using current customer data and data from the past. We use the results in order to be able to address you in a more targeted and targeted manner.
11. What rights of objection do I have? (Art. 21 GDPR)
11.1 Right of objection in individual cases
For reasons that arise from your particular situation, you have the right to object at any time to the processing of personal data relating to you, which is based on Article 6 (1) (f) GDPR (data processing based on a weighing of interests). This also applies to profiling based on this provision within the meaning of Art. 4 No. 4 GDPR, which can be used, for example, for customer advice and support and for sales purposes.
If you object, we will no longer process your personal data unless we can prove compelling legitimate reasons for processing that outweigh your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.
11.2 Right to object to the processing of data for direct marketing purposes
We can also process your data for direct mail within the framework of the statutory provisions. You have the right to object at any time to the processing of personal data concerning you for the purpose of such advertising. This also applies to profiling insofar as it is related to such direct mail.

12. General information on data protection
As soon as you access our website, your web browser begins to transmit data to our server for technical reasons. You can also request information about the purpose of the data processing. You also have the right to correct, delete or block your data. 14. Objection to unsolicited advertising
We object to any use of our contact data by third parties for the purpose of sending us unsolicited advertising in any form. In the event of a violation, we reserve the right to take legal action against the sender.
