Scope and provider

These general terms and conditions apply to all orders that you place via the online shop of

The range of goods in our online shop is aimed at companies and consumers (who have reached the age of 18).

 

  • Our deliveries, services and offers are made exclusively on the basis of these general terms and conditions. Terms and conditions of the customers or third parties do not apply, even if MTM Marketing GmbH does not separately contradict their validity in individual cases.

  • Contract language is German.

  • The contract is subject to German law to the exclusion of the UN sales law.

  • The competent court in Landsberg / Lech is solely responsible for deciding on any disputes arising in connection with the contractual relationship.

  • You can access and print out the currently valid general terms and conditions for the Rist online shop on the website.

Offer and conclusion of contract

  • The presentation of goods on the website does not constitute a binding application to conclude a purchase contract. Rather, it is a non-binding invitation to order goods in the online shop.

  • The article images shown are partly symbolic images.

  • Changes in the offer, technical changes, errors in the content and delivery options reserved. All information is subject to change.

  • By clicking the button "Order for a fee" you are submitting a binding purchase offer.

  • After receipt of the purchase offer, you will receive an email with which we confirm that we have received your order (confirmation of receipt). An invoice is attached to this email.

  • A purchase contract for the goods is only concluded when we have received the full invoice amount.

Prices and payment

  • The prices stated in this offer are generally net prices plus VAT. Exceptions are articles that are specifically classified as "incl. VAT ”. All prices shown in our online shop do not include the respective shipping costs.

  • With the appearance of this offer, all previous prices lose their validity.

  • Payment is made by bank transfer in advance, PayPal or instant transfer. The payment method by invoice is available for registered greeting trade customers (payable upon receipt). When buying on account, we carry out a credit check, which we use to decide whether you are allowed to pay on account.

  • If you fall into arrears with a payment, you are obliged to pay the statutory default interest of 1.5% pm above the bank interest rate. All reminder and collection charges are to be reimbursed.

  • If, after the conclusion of the contract, circumstances become known which give rise to doubts about the creditworthiness of the customer and which endanger the payment of the outstanding claims from the respective contractual relationship, MTM Marketing GmbH is entitled to withdraw from the contract immediately.

  • MTM Marketing GmbH is entitled to increase prices appropriately if the delivery date is more than 6 months after the conclusion of the contract. The prices valid on the day of delivery then apply. The prices are adjusted to the changed price bases (material, wages, etc.).

Delivery and retention of title

  • Unless otherwise agreed, the goods will be delivered from our warehouse to the address you provided.

  • When the delivery item is handed over to the forwarding agent, carrier or any other third party appointed to carry out the shipment, the risk is transferred to the customer. This also applies if partial deliveries are made. If the dispatch is delayed due to circumstances for which the customer is responsible, the risk is transferred to the customer at the point in time at which MTM Marketing GmbH is ready for dispatch and has notified the customer of this.

  • The goods remain our property until the purchase price has been paid in full. The seller is also expressly entitled to assert a right of separation in the event that the buyer should urgently need the goods to continue his business. The buyer hereby expressly waives for himself and his legal successors to invoke legal provisions to the contrary, which exclude the assertion of a right of separation or which are linked to conditions of whatever kind.

  • MTM Marketing GmbH is entitled to make partial deliveries, provided the customer does not incur any significant additional effort and / or additional costs.

  • The delivery must be checked for completeness and intactness in the presence of the deliverer. Defects are to be noted on the shipping papers and acknowledged by the deliverer.

Correct behavior when taking delivery

  • The goods you have ordered are carefully checked and carefully packed. Only accept packages that are externally undamaged, as well as packages that do not indicate breakage when shaken!

  • Report any damage to us within 14 hours of delivery (in writing or orally)!

  • Keep the defective shipment - defective goods and packaging - at our disposal!

Guarantee

Any warranty claims are to be asserted within a preclusive period of 6 months from delivery, whereby the current statutory period applies to consumers.

Return service

You have a right of return within 14 working days. The withdrawal period begins on the day of delivery (Saturdays, Sundays and public holidays are not included). The revocation or the declaration of withdrawal must be sent by email, fax or post within the above-mentioned period and the goods sent back to us. The return shipment is at the expense and risk of the customer. When we receive the goods, we will refund the purchase price paid. We reserve the right to charge an appropriate fee for processing, any depreciation and re-storage of the goods. The right of withdrawal does not apply to custom-made items, used items and goods that are unsuitable for return due to their nature. We reserve the right to refuse the right of return for order quantities that are outside of our usual delivery quantities.

Final provisions

  • Should one or more provisions of these terms and conditions be or become ineffective, this shall not affect the effectiveness of the other provisions.

  • The place of performance and exclusive place of jurisdiction for all disputes arising from the business relationship between MTM Marketing GmbH and the customer is Landsberg / Lech. German law applies.

  • Additional agreements must be made in writing.
